Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the greatest extent permitted by applicable law.

11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact Wings Over in writing at [email protected] and provide a detailed description of your dispute, including the relief sought. Both parties agree to make a good-faith effort to resolve the dispute informally within thirty (30) days of the date the notice is received. This informal dispute resolution process is a prerequisite to initiating any arbitration or litigation.
11.2 Binding Arbitration
If the parties cannot resolve the dispute through informal means within the specified period, any unresolved dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be finally resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association ("AAA") or JAMS, as mutually agreed upon by the parties. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding on both parties.
The arbitration shall take place in the state in which Wings Over is principally located, or, at the User's election, may be conducted via telephone or videoconference if the amount in dispute is less than ten thousand U.S. dollars ($10,000.00). The costs of arbitration shall be allocated in accordance with the applicable arbitration rules.
11.3 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST WINGS OVER. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
11.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.
